Terms of Use

These Terms govern your use of Trustless Commerce software and services.

Last updated: 1 September 2026. These documents are provided in English and apply regardless of your selected UI language.

1. Agreement

These Terms of Use ("Terms") are a binding agreement between you and the operator of Trustless Commerce ("we", "us", "our"). By accessing or using our website, wallet software, invoice and pay links, Super Wallet features, merchant tools, APIs, or any related services (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction. You may not use the Services if you are prohibited from doing so under applicable law, including sanctions or export-control restrictions.

3. The Services

Trustless Commerce provides non-custodial software for passkey-secured smart wallets, crypto invoicing, hosted checkout, optional team multisig (Super Wallet), and related business tools. We may add, change, or discontinue features at any time.

The Services are software tools only. We do not hold, safeguard, or control digital assets on your behalf.

4. Not a custodian, bank, broker, or exchange

Trustless Commerce is not a bank, broker-dealer, money transmitter, custodian, or exchange. We do not take possession of your funds, cannot freeze or reverse on-chain transactions, and cannot restore access to a wallet if you lose every authorized device and have not configured recovery.

5. Wallets, passkeys, and your responsibilities

Your wallet is controlled by cryptographic keys created and stored on your device through WebAuthn (passkeys) or compatible security keys. Private keys remain on your authenticator. We store only public key coordinates, credential identifiers, and metadata needed to operate the Services.

Trustless Commerce does not provide seed phrases. You are solely responsible for:

  • Keeping your devices secure and your biometrics or device PIN private.
  • Pairing additional trusted devices before you need them.
  • Configuring email and guardian recovery where available.
  • Verifying recipient addresses and transaction details before signing.
  • Understanding that a legacy Super Wallet upgrade is irreversible and disables email recovery. An Identity Super Wallet is beta, unaudited, and email recovery stays available.

6. Transactions

Blockchain transactions are generally irreversible. You are responsible for network fees and for ensuring you send assets on the correct chain and to the correct address. We are not responsible for user error, smart-contract behavior on third-party networks, or failures of RPC providers, bundlers, or blockchains.

7. Fees

You may pay network fees to third parties and, where disclosed, service fees to us. We may change fees with reasonable notice where practicable. Continued use after a fee change constitutes acceptance.

8. Acceptable use

You agree not to use the Services to:

  • Violate any law or regulation, including anti-money-laundering and sanctions rules.
  • Infringe intellectual property or privacy rights.
  • Transmit malware, attempt unauthorized access, or abuse the API.
  • Interfere with the integrity or availability of the Services.

9. Third-party services

The Services may interact with third-party blockchains, RPC endpoints, account-abstraction bundlers, email providers, fiat on/off-ramp partners, and integration platforms. Those services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party services.

10. Intellectual property

Trustless Commerce names, logos, UI, and documentation are protected by applicable intellectual-property laws. These Terms do not grant you ownership of our software or brand. Open-source components may be available under separate licenses as indicated in our repository.

11. Privacy

Our Privacy Policy explains how we handle information. By using the Services, you acknowledge that policy.

12. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

14. Indemnity

You will defend, indemnify, and hold us harmless from claims arising out of your misuse of the Services, violation of these Terms, or violation of applicable law.

15. Changes

We may update these Terms from time to time. We will post the revised Terms with an updated date. Material changes may also be communicated through the Services where practicable. Continued use after changes become effective constitutes acceptance.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. Termination does not affect on-chain assets you control outside our custody.

17. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. You agree that state and federal courts located in Wyoming have exclusive jurisdiction over disputes arising from these Terms or the Services, except where prohibited by law.
